1Purpose
1.1This Statement describes the principal risks of using the FinzoPark Platform and of transacting in crypto-assets through it. It forms part of the Terms of Use.
1.2The risks listed are not exhaustive and are not in order of importance. Nothing here is investment advice or a recommendation. You transact on your own judgement and at your own risk.
2Structural Risk — What FinzoPark Is and Is Not
2.1FinzoPark operates a customer-facing trading interface integrated with the APIs and related infrastructure provided by Binance and Bybit. Depending on the applicable service arrangements, Binance and/or Bybit may provide underlying trading infrastructure, liquidity, execution, KYC/AML and, where applicable, custody services.
2.2Consequently, FinzoPark cannot: execute or guarantee a trade; hold, move, recover or return your assets; reverse, cancel or reprice an executed transaction; open, verify, unlock, restrict or close your Binance or Bybit account; release a frozen balance; process a deposit or withdrawal; or compel Binance or Bybit to take any action.
2.3Your legal protections in respect of your funds and crypto-assets are those provided by the applicable Binance or Bybit entity under its respective Terms and by the law applicable to that provider. They are not provided by FinzoPark. Before transacting you should read the applicable Binance or Bybit Terms and understand what they do and do not give you.
2.4FinzoPark may receive a commission based on transaction activity generated through the Platform. Under the applicable Binance partner arrangement, this includes 30% of eligible Binance trading fees attributable to that activity, subject to the applicable terms of the Binance partner agreement. Any remuneration received from Bybit is subject to the applicable Bybit partner agreement and commercial terms. Our remuneration may therefore rise with your trading volume. See the Fee and Remuneration Disclosure for how this conflict is managed. Higher trading frequency increases your costs and is not, of itself, in your interest.
3Dependency and Concentration Risk
3.1The Platform depends on third-party venues and infrastructure. If Binance or Bybit suspends its API, changes its endpoints, restricts your account, withdraws a market, imposes rate limits, or terminates its arrangement with FinzoPark, some or all Platform functionality may cease, potentially without notice and at a time of market stress.
3.2We have no control over Binance’s or Bybit’s commercial, technical, compliance or jurisdictional decisions, and may receive no advance warning of them.
3.3Binance and Bybit are subject to their own regulatory, legal, operational and financial risks in multiple jurisdictions. Adverse developments affecting either provider may affect your access to your assets regardless of anything FinzoPark does.
3.4You should maintain independent, direct access to your Binance and/or Bybit account, including current credentials and recovery methods, so that you can act on your positions if the Platform is unavailable.
4Execution Risk
4.1Instructions are transmitted to Binance or Bybit, as applicable, for execution. There is no guarantee that an Instruction will be received, transmitted, accepted, executed in whole or in part, or executed at any particular price or time.
4.2Instructions may be delayed, throttled, rejected or cancelled because of API rate limits, maintenance windows, connectivity failure, risk controls, account status or market conditions.
4.3Slippage.The executed price may differ materially from the price displayed when you submitted the Instruction, particularly for market orders, large orders and volatile conditions.
4.4Latency.Data passes through additional systems before reaching Binance or Bybit, as applicable. Displayed prices, balances and order states may be momentarily out of date, and the extra hop introduces latency relative to trading directly with the applicable provider.
4.5Finality.Executed transactions cannot be reversed by FinzoPark under any circumstances.
5Data and Display Risk
5.1Balances, positions, valuations, profit and loss figures, order status and history shown on the Platform are derived from data supplied by Binance, Bybit, and third-party data providers, as applicable. They are provided for convenience and may be delayed, incomplete, cached or erroneous.
5.2The applicable Binance or Bybit provider’s own records are definitive. Where the Platform and the applicable provider differ, you must rely on the provider’s records. Do not make a trading decision on the basis of a Platform display without confirming it against your Binance or Bybit account where the amount is material to you.
5.3Analytics, charts, indicators, rankings and educational content may contain errors, rely on assumptions, or become stale, and must not be treated as advice or as a prediction.
6API Key and Security Risk
6.1Use of the Platform requires you to connect an API Key issued by Binance or Bybit, as applicable. Any credential you create expands the number of places where a compromise could occur, including your own device and email account.
6.2You must connect only trade-and-read API Keys and must never enable withdrawal permissions on a key connected to the Platform. A withdrawal-enabled key materially increases the risk of irrecoverable loss if compromised anywhere.
6.3Compromise of your API Key, Platform credentials, device or email may allow a third party to place trades in your account. Trades placed this way execute at market and cannot be reversed.
6.4You should apply IP whitelisting where supported, review connected applications regularly, and revoke keys you no longer use. Revocation is performed by you in your Binance or Bybit account, as applicable.
6.5FinzoPark will never ask for your Binance or Bybit password, recovery phrase, two-factor authentication codes, or a withdrawal-enabled key, and will never ask you to send funds or crypto-assets to us.
7Market and Volatility Risk
7.1Crypto-asset prices are extremely volatile and trade continuously, including at weekends and overnight. Very large percentage moves can occur within minutes.
7.2Prices may be affected by macroeconomic conditions, regulatory announcements, network events, exchange incidents, large-holder activity, social media sentiment and speculative flows.
7.3Past performance, backtests, historical charts and simulated results are not reliable indicators of future results.
7.4Most crypto-assets are not backed by any government, central bank, physical asset or issuer balance sheet, and confer no legal claim against any person. There is no floor to their price.
8Liquidity Risk
8.1Liquidity can deteriorate suddenly. Spreads widen, book depth thins, and it may become impossible to trade at or near the displayed price, in the size you want, or at all.
8.2Smaller-capitalisation assets may be thinly traded and concentrated in few holders, and may be delisted by Binance or Bybit at short notice, after which they may become effectively untradeable through the Platform.
8.3Available markets and assets are determined by Binance, Bybit, and the scope of the applicable API integrations, and may be reduced at any time.
9Custody, Transfer and Blockchain Risk
9.1Your assets are held in your Binance or Bybit account, as applicable, under the respective provider’s Terms. Where assets are held in omnibus arrangements, your entitlement is determined by the applicable provider’s internal records. In an insolvency, recovery may be partial, delayed for a long period, and subject to foreign insolvency law.
9.2Deposits and withdrawals are performed by you directly with Binance or Bybit, as applicable. FinzoPark cannot initiate, expedite, block, reverse or recover them.
9.3On-chain transfers are irreversible. Sending to a wrong address, an incompatible network, or omitting a required memo or tag normally results in permanent loss.
9.4Networks may become congested, suffer protocol failures, undergo forks or reorganisations, or be attacked. Support for forks and airdrops is determined by Binance or Bybit, as applicable, and unsupported events may result in loss of the associated value.
9.5Tokens dependent on smart contracts may contain defects, privileged administrator functions or exploitable vulnerabilities, and may lose all value.
10Counterparty and Stablecoin Risk
10.1Stablecoin exposure carries the credit and operational risk of the issuer and of the reserve assets. A peg may break temporarily or permanently, redemptions may be suspended, addresses may be frozen or blacklisted by the issuer, and support may be withdrawn at short notice.
10.2Banks, payment providers and custody arrangements used by Binance or Bybit carry their own credit, operational and de-risking risks that may affect your ability to fund or withdraw.
11Regulatory and Access Risk
11.1The regulatory treatment of crypto-assets differs by jurisdiction and is changing rapidly, sometimes with immediate or retrospective effect.
11.2Regulatory change may require FinzoPark to restrict or withdraw the Platform in a jurisdiction, remove features or markets, or cease operating entirely. It may equally require Binance or Bybit to restrict your account, delist an asset, or exit a market.
11.3Access to the Platform may be geo-restricted. Attempting to circumvent restrictions may result in loss of access and, separately, in action by Binance or Bybit against your account.
11.4You are responsible for confirming that your use of the Platform and of Binance’s and/or Bybit’s services is lawful where you are located.
12No Compensation Scheme
12.1Neither crypto-assets nor fiat balances held with Binance or Bybit are protected by any deposit guarantee or investor compensation scheme, and FinzoPark provides no guarantee, insurance or indemnity in respect of them.
12.2If Binance, Bybit, a custody provider, a bank or FinzoPark becomes insolvent or suffers a security failure, you may lose some or all of your assets, and recovery may be partial and long delayed.
13Technology and Availability Risk
13.1The Platform may be unavailable or degraded due to maintenance, upgrades, capacity limits, software defects, third-party outages, cyber attack or force majeure. You may be unable to place, amend or cancel Instructions during such periods, including at times of extreme price movement.
13.2Crypto services are persistent targets of intrusion, malware, supply-chain compromise, social engineering, SIM-swap and phishing, including impersonation of FinzoPark, Binance or Bybit support.
13.3Automated, scheduled or rule-based Instructions continue to run until cancelled and may execute at unfavourable prices during volatility or data outages.
14Fraud and Market Abuse Risk
14.1Crypto markets have exhibited manipulation including wash trading, spoofing, layering, pump-and-dump schemes, coordinated promotion and misleading issuer disclosure. Reported volumes and market capitalisation figures may be inaccurate.
14.2Be alert to recovery scams, fake support channels, impersonation of staff, romance and social engineering fraud, and any offer of guaranteed returns. Report suspected fraud to security@finzopark.org and, where relevant, to Binance or Bybit through their respective official support channels.
15Tax Risk
15.1Tax treatment depends on your circumstances and jurisdiction and may change, including retrospectively. You are solely responsible for determining, reporting and paying any tax due and for keeping adequate records. FinzoPark does not provide tax advice, and Platform reports are not tax statements.
16No Advice or Suitability Assessment
16.1FinzoPark provides interface and information services only. It does not assess the suitability or appropriateness of any asset or transaction for you and does not consider your objectives, financial situation, knowledge, experience or risk tolerance.
16.2Consider taking independent financial, legal and tax advice before transacting.
17Acknowledgement
By using the Platform you acknowledge that you have read and understood this Statement, that you accept the risks described including total loss, that you understand FinzoPark holds none of your assets and cannot recover them, and that you can bear the financial consequences of your decisions.
